Deposits should not be given for a litter that is not born yet ! If the litter only produces 1 or 2 pups or some which are stillborn or some don't survive (which when breeding on a mass scale as a business does happen) you would have lost your deposit. If you insist on giving a deposit in such circumstances, make sure you have it in writing (through the postal service) from the breeder, that your deposit will be returned and not kept for the next litter so you can go elsewhere to buy a pup.
